By accessing or using FastFuel ("the App"), including the website at fastfuel.training and the FastFuel mobile application available on iOS and Android, you agree to be bound by these Terms & Conditions. If you do not agree, do not use the App. You represent and warrant that you are of legal age to form a binding contract (or if not, you have received your parent's or guardian's permission to use the App and have gotten your parent or guardian to agree to these Terms on your behalf).
FastFuel is a nutrition planning tool for endurance athletes. It generates macro targets based on training data and user-provided settings. FastFuel is designed as a self-help tool and does not include the provision of medical care or other professional health services. You will only use the App for your own internal, personal, non-commercial use, and only in a manner that complies with all laws that apply to you.
The information provided by FastFuel is for informational and educational purposes only. It is not intended as a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before making changes to your diet or exercise program.
You acknowledge that no licensed medical professional/patient relationship is created by using information provided by or through the App. The content is not and should not be considered medical advice or a substitute for individual medical advice, diagnosis, or treatment. Do not disregard, avoid, or delay obtaining medical advice from a qualified health care professional because of something you may have read or received through the App.
USE OF THE APP IS NOT FOR EMERGENCIES. IF YOU THINK YOU HAVE A MEDICAL EMERGENCY, CALL 911 OR GO TO THE NEAREST OPEN CLINIC OR EMERGENCY ROOM.
The Children's Online Privacy Protection Act ("COPPA") requires that online service providers obtain parental consent before they knowingly collect personally identifiable information from children under 13. We do not knowingly collect or solicit personally identifiable information from children under 13. If you are a child under 13, please do not attempt to register or send any personal information about yourself to us. If we learn we have collected personal information from a child under 13, we will delete that information as quickly as possible and terminate the associated account. If you believe that a child under 13 may have provided us personal information, please contact us at stephanie@dragonflywebdesigns.com.
You promise to provide accurate, complete, and updated information about yourself. You are responsible for any activity associated with your account and for the accuracy of data you provide. FastFuel stores your settings and nutrition logs to provide the service. See our Privacy Policy for details on data handling.
You represent, warrant, and agree that you will not:
A violation of any of the foregoing is grounds for termination of your right to use the App.
The materials displayed or available through the App, including but not limited to text, graphics, data, articles, photos, images, and illustrations ("Content") are protected by copyright and/or other intellectual property laws. You will not use, copy, reproduce, modify, translate, publish, broadcast, transmit, distribute, perform, upload, display, license, sell, or otherwise exploit for any purpose any Content not owned by you without the prior consent of the owner.
You understand that Dragonfly Web Designs, LLC owns the App and all associated intellectual property. You will not modify, publish, transmit, participate in the transfer or sale of, reproduce, or create derivative works based on the App.
FastFuel integrates with third-party services including Athletica.ai, Intervals.icu, Strava, Garmin Connect, FatSecret, and any other services connected through Intervals.icu. Your use of these services is governed by their respective terms. FastFuel is not responsible for the accuracy or availability of third-party data.
FastFuel has no control over, and assumes no responsibility for, the content, accuracy, privacy policies, or practices of any third-party websites or services. By using the App, you release and hold us harmless from any and all liability arising from your use of any third-party website or service.
THE APP AND CONTENT ARE PROVIDED ON AN "AS-IS" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT USE OF THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.
TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY (INCLUDING, WITHOUT LIMITATION, TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE) SHALL FASTFUEL OR DRAGONFLY WEB DESIGNS, LLC BE LIABLE TO YOU OR TO ANY OTHER PERSON FOR (A) ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING DAMAGES FOR LOST PROFITS, LOSS OF GOODWILL, WORK STOPPAGE, ACCURACY OF RESULTS, OR COMPUTER FAILURE OR MALFUNCTION, OR (B) ANY AMOUNT, IN THE AGGREGATE, IN EXCESS OF $100, OR (C) ANY MATTER BEYOND OUR REASONABLE CONTROL.
This includes but is not limited to health outcomes, training decisions, dietary decisions, or data loss.
You agree to indemnify and hold Dragonfly Web Designs, LLC, its affiliates, officers, agents, employees, and partners harmless for and against any and all claims, liabilities, damages (actual and consequential), losses, and expenses (including attorneys' fees) arising from or in any way related to (a) your use of the App (including any actions taken by a third party using your account), and (b) your violation of these Terms.
You may stop using the App at any time by deleting your account from the Settings page or contacting us at stephanie@dragonflywebdesigns.com. FastFuel is also free to terminate or suspend access to your account for any reason at our discretion, including breach of these Terms. Account termination may result in the destruction of content associated with your account.
These Terms are governed by and will be construed under the laws of the State of New Mexico, without regard to the conflicts of laws provisions thereof. Any dispute arising from or relating to these Terms shall be resolved in the courts located in Grant County, New Mexico.
We may update these terms at any time. If we make material changes, we will attempt to notify you by email or through the App. Continued use of the App after changes constitutes acceptance of the new terms. If you do not agree with the new terms, you are free to reject them, but you will no longer be able to use the App.
